How Would a Risperdal Class Action Work?

In a Risperdal class action lawsuit, one or more plaintiffs would file a lawsuit on behalf of a larger group, or “class”, composed of other individuals who are also alleging injuries due to Risperdal. One member of this group would be designated the “class representative,” and would be listed as the lead plaintiff on the complaint. This individual would have control over many important aspects of the case, including the choice of attorney, and whether or not to accept any proposed settlement on behalf of the class members.

If a settlement or judgment is made in favor of class members in a Risperdal class action, it is likely that any funds recovered would be equally distributed among all plaintiffs.  Even if you feel that your share of the recovery is unfair, you may be barred by the terms of the settlement from filing your own individual lawsuit.

Generally, class action lawsuits are the best choice for plaintiffs who have suffered identical injuries, and sustained the same type of damages.  In the case of Risperdal, victim have developed gynecomastia ranging from mild to very serious, and each plaintiff’s medical bills and other damages can be expected to vary greatly. How Does an Individual Risperdal Lawsuit Work?

Unlike a Risperdal class action, an individual case will maintain its own identity throughout the entire legal process. The plaintiff in an individual claim will also be able to choose their own attorney, and will make all important decisions relating to the litigation of their case, including whether or not to go to trial, or accept a settlement offer.

Some Risperdal lawsuits alleging the drug caused gynecomastia and other injuries have been consolidated in a mass tort proceeding underway in the Philadelphia Court of Common Pleas in Pennsylvania. While this process allows the cases to go through coordinated pretrial proceedings, including discovery, it is very different from a Risperdal class action lawsuit. Among other things, each case filed in the litigation maintains its own identity, and plaintiffs remain in control of their individual lawsuit.
